[01:13.000 --> 01:36.000] If you've watched or listened to my presentations over time, you've almost certainly heard me discuss the fact that from 1913, when the modern income tax was enacted, until this very moment, there are 10 Treasury decisions in which the Secretary of the Treasury instructs employees of the Treasury Department, the IRS, and the public who is to use a Form 1040. [01:36.000 --> 01:54.000] Before I discuss those 10 Treasury decisions with you, you may find it interesting to know that nowhere in the tax statutes passed by Congress does it say who is to use a Form 1040, and nowhere in the regulations promulgated by the Secretary of the Treasury does it say who is to use a Form 1040. [01:54.000 --> 02:03.000] In fact, neither the statutes nor the regulations ever mention which return is to be used by an individual whose income tax. [02:03.000 --> 02:13.000] The significance of that is it is impossible to know who the Secretary has instructed to use a Form 1040 unless one tracks down the relevant Treasury decisions. [02:13.000 --> 02:35.000] Those Treasury decisions are 1928, 1953, 2013, 2109, 2313, 2401, 2402, 2815, 2988, and 6500. [02:35.000 --> 02:43.000] Now that you know which Treasury decisions speak to the use of a Form 1040, what do they say? [02:43.000 --> 02:59.000] Each and every one says that Form 1040 is to be used by a non-resident alien or his domestic agent to report the non-resident alien's U.S. source income. [03:25.000 --> 03:33.000] You may find it interesting to learn that in the 111 years since the adoption of the income tax, [03:33.000 --> 03:42.000] there is no Treasury decision in existence that instructs the American people that a Form 1040 is to be used by anyone [03:42.000 --> 03:48.000] other than a non-resident alien with U.S. source income or the non-resident alien's domestic agent. [03:49.000 --> 03:53.000] So how does all this tie into Form W-4? [03:53.000 --> 03:56.000] I believe the most obvious connection is self-evident. [03:56.000 --> 04:05.000] When a person has income tax withheld from his or her paycheck, what return does the IRS expect you to file on or before April 15th of the following year? [04:05.000 --> 04:07.000] A 1040, of course. [04:07.000 --> 04:14.000] So if the money withheld from your paycheck is for a tax Congress has imposed on you, [04:14.000 --> 04:19.000] why would the IRS tell you that because of that withholding you are required to file a return [04:19.000 --> 04:26.000] that is exclusively for the use of non-resident aliens with U.S. source income or the non-resident alien's domestic agent? [04:26.000 --> 04:32.000] Are you a non-resident alien or the domestic agent of a non-resident alien? [04:32.000 --> 04:38.000] Does it not make a lot more sense that the tax being withheld from the paycheck of a person required to file a 1040 [04:38.000 --> 04:44.000] is the tax owed by a non-resident alien, not Americans working in the states of the Union? [04:44.000 --> 04:48.000] Now let's take a look at the instructions provided for the Form W-4. [04:48.000 --> 04:55.000] The first page of the W-4 instructions begin with the words General Instructions. [04:55.000 --> 05:01.000] If we move down to the third paragraph entitled Exemption from Withholding, we find this, [05:09.000 --> 05:18.000] You had no federal income tax liability in 2023 and you expect to have no federal income tax liability in 2024. [05:18.000 --> 05:25.000] Now, pay careful attention to what it says next. [05:25.000 --> 05:31.000] To assert you had no federal income tax liability in 2023, [05:38.000 --> 05:45.000] So, for 111 years, the U.S. Secretary of the Treasury, who is the highest tax authority in the government, [05:45.000 --> 05:52.000] has repeatedly stated Form 1040 is to be used exclusively by non-resident aliens with U.S. source income [05:52.000 --> 05:55.000] or the non-resident alien's domestic agent. [05:55.000 --> 06:01.000] Yet, to say you did not have federal income tax liability, [06:02.000 --> 06:05.000] with your source income or the non-resident alien's domestic agent. [06:05.000 --> 06:11.000] Yet, to say you don't want any withholding done, in other words, to go exempt, [06:11.000 --> 06:16.000] in the previous year you must have filed a return in which you stated under oath [06:16.000 --> 06:20.000] you are a non-resident alien with U.S. source income. [06:20.000 --> 06:26.000] Continuing on the first page of the instructions, we find this in what is called Step 4. [06:32.000 --> 06:42.000] In other words, if you prefer one kind of withholding over another form of withholding, [06:42.000 --> 06:50.000] you can do that utilizing a 1040 ES, which is also exclusively for non-resident aliens with U.S. source income. [06:50.000 --> 06:56.000] Moving to page 2 of the instructions and looking at Step 4B, Item 4, [06:57.000 --> 06:59.000] we find this, quote, [07:10.000 --> 07:12.000] So, here we go again. [07:12.000 --> 07:19.000] You are to make withholding adjustments on a Form W-4 based on the numbers you will include on your Form 1040, [07:19.000 --> 07:23.000] which is exclusively for non-resident aliens with U.S. source income. [07:23.000 --> 07:31.000] You might be surprised, even stunned, to hear the way payroll withholding is commanded in the law. [07:31.000 --> 07:38.000] The command to withhold is found at 26 USC 3402A and reads as follows, quote, [07:46.000 --> 07:51.000] Okay, so there are more than 200 federal taxes in existence. [07:51.000 --> 08:00.000] So let me read that again, and I want you to name the specific tax the withholding is to be done upon. [08:00.000 --> 08:02.000] But here's the thing. [08:02.000 --> 08:11.000] You cannot presume which tax because of the way you've been socialized to believe payroll withholding works. [08:11.000 --> 08:19.000] You can only determine the specific type of tax from the exact language used in the statute. [08:20.000 --> 08:21.000] Are you ready? [08:31.000 --> 08:38.000] So, based on the language you just heard, to which specific tax is withholding applied? [08:38.000 --> 08:42.000] Let me give you a couple of indicators and you can make up your own mind. [08:42.000 --> 08:48.000] First, if we scroll down in Section 3402F1A1, it states, quote, [08:49.000 --> 08:54.000] An employee receiving wages shall on any day be entitled to the following exemptions, [08:54.000 --> 09:00.000] an exemption for himself unless he is an individual described in Section 151D. [09:00.000 --> 09:08.000] This is telling because it ties the exemptions to Section 151, which is in Subtitle A, [09:08.000 --> 09:14.000] and Subtitle A is the tax imposed on the U.S. source income belonging to non-resident aliens. [09:15.000 --> 09:21.000] In income tax shattering the mess, I provide mountains of incontrovertible legal evidence [09:21.000 --> 09:26.000] that will convince even the most ardent skeptic that Subtitle A, commonly referred to as income tax, [09:26.000 --> 09:30.000] is upon the U.S. source income of non-resident aliens. [09:30.000 --> 09:35.000] But to keep this video short, let's just employ a little bit of gobbinsense. [09:35.000 --> 09:39.000] If you and I were sitting with an IRS employee and we asked him or her [09:39.000 --> 09:43.000] what return the IRS expects a person with Subtitle A liability to file, [09:43.000 --> 09:49.000] without a moment's hesitation the IRS employee would say, Form 1040. [09:49.000 --> 09:54.000] Yet we already know that in 111 years the only direction given by the U.S. Treasury Department [09:54.000 --> 10:01.000] about Form 1040 is for the exclusive use of a non-resident alien with U.S. source income or as domestic agent. [10:01.000 --> 10:07.000] So then, if the IRS tells you the proper return to file for Subtitle A liability [10:07.000 --> 10:12.000] is the return only to be used for the U.S. source income of a non-resident alien, [10:12.000 --> 10:17.000] then upon whom is Subtitle A tax imposed? [10:17.000 --> 10:20.000] Yeah, pretty simple stuff for people without cognitive dissonance. [10:20.000 --> 10:24.000] Then we come to the matter that anyone who performs withholding [10:24.000 --> 10:28.000] is what the tax code refers to as a withholding agent. [10:28.000 --> 10:32.000] So what is the definition of withholding agent? [10:32.000 --> 10:36.000] That appears at 26 USC 1441A and reads, [10:37.000 --> 10:43.000] Except as otherwise provided in Subsection C, all persons in whatever capacity acting, [10:43.000 --> 10:47.000] having the control, receipt, custody, disposal, or payment of any items of income [10:47.000 --> 10:51.000] of any non-resident alien individual. [10:51.000 --> 10:56.000] Hmm. Where is the withholding agent definition authorizing or permitting withholding [10:56.000 --> 10:59.000] on the domestic earnings of an American citizen? [10:59.000 --> 11:04.000] Answer. It does not exist. [11:04.000 --> 11:09.000] Treasury Decision 8734 is entitled Withholding of Tax on Non-Resident Aliens [11:09.000 --> 11:14.000] and deals exclusively with what the title says, withholding on non-resident aliens. [11:14.000 --> 11:21.000] Before I read apart from 8734 to you, allow me to remind you that Section 3402 [11:21.000 --> 11:24.000] is the command to engage in payroll withholding. [11:24.000 --> 11:28.000] In Treasury Decision 8734 we find this, [11:34.000 --> 11:42.000] such as Section 3406 Backup Withholding and Section 3402 Wage Withholding. [11:42.000 --> 11:47.000] In other words, the Secretary of the Treasury is saying withholding under 3402 pertains [11:47.000 --> 11:53.000] to the payment of U.S. source income made to non-resident aliens. [11:53.000 --> 11:59.000] In 111 years, where is the Treasury decision stating withholding under 3402 [11:59.000 --> 12:04.000] to be conducted upon the domestic earnings of a U.S. citizen working in any one of the 50 states? [12:04.000 --> 12:09.000] Answer. None exists. [12:09.000 --> 12:11.000] In 111 years. [12:11.000 --> 12:16.000] So tell me, since every single aspect of the law pertaining to payroll withholding [12:16.000 --> 12:20.000] leads directly to a non-resident alien with U.S. source income, [12:20.000 --> 12:24.000] who do you think is required to submit a Form W-4? [12:24.000 --> 12:28.000] Again, pretty simple stuff for people without cognitive dissonance. [12:28.000 --> 12:31.000] Let's take a quick look at the matter from another perspective. [12:31.000 --> 12:38.000] The Supreme Court has ruled that when Congress provides a definition for a term it places into federal law, [12:38.000 --> 12:46.000] the exact wording used by Congress is the only meaning that can be given to the term. [12:46.000 --> 12:51.000] One cannot apply a meaning from the standard English dictionary or make up their own meaning. [12:51.000 --> 12:56.000] The only valid meaning is that given to the term by Congress. [12:56.000 --> 13:02.000] With that in mind, let's look at the definition of employee for the purpose of payroll withholding. [13:02.000 --> 13:08.000] That's found in 26 U.S.C. 3401C and reads as follows, [13:08.000 --> 13:15.000] For the purpose of this chapter, the term employee includes an officer, employee or elected official of the United States, [13:15.000 --> 13:19.000] a state, or any political subdivision thereof, or the District of Columbia, [13:19.000 --> 13:23.000] or any agency or instrumentality of any one or more of the foregoing. [13:23.000 --> 13:27.000] Let's read the list Congress gave us again. [13:27.000 --> 13:32.000] An officer, employee, or elected official of the United States. [13:32.000 --> 13:34.000] Are you one of those? [13:34.000 --> 13:41.000] An officer, employee, or elected official of a state, which means federal states, not the states of the Union. [13:41.000 --> 13:44.000] Are you one of those? [13:44.000 --> 13:52.000] An officer, employee, or elected official of a political subdivision of the United States or a state. [13:52.000 --> 13:54.000] Are you one of those? [13:54.000 --> 13:58.000] An officer, employee, or elected official of Washington, D.C. [13:58.000 --> 14:00.000] Are you one of those? [14:00.000 --> 14:03.000] That's the complete list. [14:03.000 --> 14:08.000] You may have noted that each one describes people working for various government entities. [14:08.000 --> 14:11.000] If you're not one of those, nothing in payroll withholding law applies to you. [14:11.000 --> 14:16.000] Now, let's quickly look at the definition of employer. [14:16.000 --> 14:18.000] That's in subsection D and reads, [14:38.000 --> 14:42.000] In other words, employer means various government entities. [14:42.000 --> 14:44.000] It has nothing to do with the private sector. [14:44.000 --> 14:52.000] So, why are you submitting a W-4 and having withholding done on your paycheck? [14:52.000 --> 14:59.000] I've done other presentations on the W-4 issue offering different evidence, but all of it leads to the same legal conclusion. [14:59.000 --> 15:05.000] Payroll withholding is not legal when applied to Americans living and working in the states of the Union, earning their own domestic source income. [15:05.000 --> 15:09.000] Period. Full stop. [15:09.000 --> 15:11.000] So, what do we do about that? [15:11.000 --> 15:17.000] If you are for a smaller company with a rational owner, I suggest people open a dialogue on the subject. [15:17.000 --> 15:23.000] I've written a handbook to help you with that called The Business Guide to Payroll Withholding. [15:23.000 --> 15:31.000] It's 13 pages and is designed to provide a decision maker with a short, concise explanation, [15:31.000 --> 15:36.000] which includes the law as to why payroll withholding cannot legally be done concerning your pay [15:36.000 --> 15:39.000] and why the company should not withhold it from you any longer. [15:39.000 --> 15:45.000] It also has a very clear legal explanation, directly from the tax code, [15:45.000 --> 15:50.000] as to why the company will not be held liable if they stop withholding from you. [15:50.000 --> 15:55.000] From the 35,000-foot level, the best solution is education. [15:55.000 --> 15:57.000] Allow me to explain. [15:57.000 --> 16:01.000] The current U.S. population is roughly 336 million people. [16:01.000 --> 16:06.000] Of that, 59 million are retired and 72 million are under 18. [16:07.000 --> 16:15.000] That means roughly 131 million people are not in the workforce, leaving us with 205 million in the workforce. [16:15.000 --> 16:18.000] It is estimated that 29 million people work for themselves. [16:18.000 --> 16:24.000] That means, in big broad terms, somewhere in the range of 176 million Americans work for someone else [16:24.000 --> 16:27.000] and likely have payroll withholding done. [16:27.000 --> 16:34.000] If we go with the 176 million number and 1 million people know the truth about payroll withholding, [16:34.000 --> 16:36.000] how much of a difference will that make? [16:36.000 --> 16:38.000] Probably not much. [16:38.000 --> 16:43.000] What if 80 million of the 176 million know? [16:43.000 --> 16:49.000] At that level, I assure you the withholding scam would collapse under its own weight [16:49.000 --> 16:54.000] because quality workers would only work for companies that had learned the truth and didn't withhold. [16:54.000 --> 17:00.000] Quality workers flocking to those companies would force every other company to stop withholding [17:00.000 --> 17:02.000] in order to compete in the marketplace. [17:02.000 --> 17:06.000] In our example, we said a million people knowing the truth would not make a difference, [17:06.000 --> 17:09.000] but 80 million would end the scam. [17:09.000 --> 17:13.000] So where exactly is that tipping point? [17:13.000 --> 17:20.000] I can't give you that number because a lot of that equation pivots on human nature and events that can't be foreseen. [17:20.000 --> 17:28.000] What is absolutely certain is that in order to kill the scam, we must work at getting our fellow Americans informed. [17:28.000 --> 17:30.000] How do we do that? [17:30.000 --> 17:34.000] Well, my friends, it starts with you. [17:34.000 --> 17:40.000] You have to be knowledgeable so you can be credible when you tell your fellow citizens about it. [17:40.000 --> 17:49.000] The way for you to be knowledgeable and thus credible when you tell others the truth is to read Income Tax Shattering the Miss.
