[00:02.600 --> 00:11.940] On February 28, 2023, Republican Florida State Senator Jason Broder filed bill SB-1316. [00:11.940 --> 00:15.600] This is one of the most disturbing bills I've seen in my lifetime. [00:15.600 --> 00:22.240] I ran a Twitter poll and 80% of respondents wanted to know more about this seriously problematic [00:22.240 --> 00:27.880] bill. [00:27.880 --> 00:39.240] The Dr. Reality Vodcast with Dave Champion. [00:39.240 --> 00:40.440] Let's start with this. [00:40.440 --> 00:44.920] The broad strokes of the bill is that it would require certain bloggers to register with [00:44.920 --> 00:49.320] state government and file monthly reports on their blogging activities. [00:49.320 --> 00:54.000] Adding to the weirdness of the bill, it will only lay the registration requirement on certain [00:54.000 --> 00:56.640] bloggers, not all of them. [00:56.640 --> 01:02.000] So if this bill becomes law, which bloggers would it target? [01:02.000 --> 01:04.320] For that, I'll read right from the bill. [01:04.320 --> 01:11.000] Quote, if a blogger posts to a blog about an elected state officer and receives or will [01:11.000 --> 01:16.680] receive compensation for that post, the blogger must register with the appropriate office. [01:16.680 --> 01:21.600] In other words, if a blogger blogs about an elected state official and gets compensated [01:21.600 --> 01:28.560] for that work, he or she would then have to register with the government. [01:28.560 --> 01:31.640] That doesn't sound fascist or communist. [01:31.640 --> 01:34.040] Nope, not at all. [01:34.040 --> 01:37.440] If you're thinking this bill is well beyond the proper reach of government, you're not [01:37.440 --> 01:40.320] alone and you're not wrong. [01:40.320 --> 01:43.400] Of course, here in America, we have free speech. [01:43.400 --> 01:50.120] But if you want to exercise free speech, you need to register with the government, said [01:50.120 --> 01:55.880] no one ever, except perhaps the governments of Russia and China and Florida Senator Broder. [01:55.880 --> 01:58.920] But wait, there's more. [01:58.920 --> 02:03.360] This bill isn't just an attack on free speech, it's also an attack on freedom of association. [02:03.360 --> 02:07.720] Once a blogger blogs about an elected state official and is compensated for his or her [02:07.720 --> 02:13.980] effort, the blogger must not only register, but must also file monthly reports disclosing [02:13.980 --> 02:17.200] the names of anyone who paid for the blogger's time. [02:17.200 --> 02:21.760] In other words, this bill requires bloggers to report the names of those with whom they [02:21.760 --> 02:23.960] associate professionally. [02:23.960 --> 02:25.440] Fascist? [02:25.440 --> 02:26.600] Communist? [02:26.600 --> 02:28.900] Nah, not a bit. [02:28.900 --> 02:33.740] As I read the bill, one of the things that caught my eye was the absurd circular definition [02:33.740 --> 02:36.240] of blog and blogger. [02:36.240 --> 02:38.320] Neither is actually defined. [02:38.320 --> 02:39.320] Check it out. [02:39.320 --> 02:45.520] Quote, blog means a website or web page that hosts any blogger. [02:45.520 --> 02:50.600] Blogger means any person that submits a blog post to a blog. [02:50.600 --> 02:55.380] Why are these definitions circular and therefore meaningless in a legal sense? [02:55.380 --> 03:00.140] It could be that the legislative draftsman did a terrible job drafting the bill. [03:00.140 --> 03:03.920] But that doesn't appear to be the case because the rest of the bill is well drafted. [03:03.920 --> 03:08.900] The far more likely reason is any true definition of blog and blogger would immediately invoke [03:08.900 --> 03:12.320] the issues of freedom of speech and freedom of the press. [03:12.320 --> 03:16.680] Republicans are big on condemning anything and everything about the Chinese government. [03:16.680 --> 03:21.700] So it's more than a little ironic that a bill to force Americans to register with the government [03:21.700 --> 03:26.680] for exercising free speech, report lawfully acquired compensation, as well as report private [03:26.680 --> 03:32.920] professional associations to the very politicians about whom the blogger blogged is something [03:32.920 --> 03:36.240] we can easily see the Chinese Communist Party doing. [03:36.240 --> 03:39.680] Can you imagine what Republicans across the nation would say if a bill like this was put [03:39.680 --> 03:43.220] forth by a Democrat in a blue state? [03:43.220 --> 03:47.320] This bill is even more corrupt because while it forces the little guy to register with [03:47.320 --> 03:52.940] the government and report his private associations and payments, it completely exempts legacy [03:52.940 --> 03:54.600] media companies. [03:54.600 --> 03:59.240] The bill distinguishes the reporting and commentary of million-dollar enterprises from the reporting [03:59.240 --> 04:01.400] and commentary of independent bloggers. [04:01.400 --> 04:05.520] Apparently, Broder is not one of those Republicans who support small business people and wants [04:05.520 --> 04:07.540] government out of their hair. [04:07.540 --> 04:11.620] To be clear, I'm not hanging this legislation around the neck of all Republicans. [04:11.620 --> 04:14.740] I'm confident most find it appalling. [04:14.740 --> 04:18.060] Numerous First Amendment groups have condemned Broder for the bill. [04:18.060 --> 04:22.260] Even Newt Gingrich, not exactly a champion of the little guy, called Broder out for his [04:22.260 --> 04:25.340] bill, tweeting that Broder should withdraw it immediately. [04:25.340 --> 04:29.940] To illustrate how quickly this bill would be struck down by the courts, one attorney [04:29.940 --> 04:35.860] said, to see how the courts would view this, replace blogger with reporter. [04:35.860 --> 04:39.660] The bill has been met with such widespread antipathy, Florida Governor DeSantis felt [04:39.660 --> 04:42.620] compelled to publicly denounce it. [04:42.620 --> 04:46.940] While DeSantis had nothing to do with the bill, left-leaning news outlets claimed, falsely, [04:46.940 --> 04:48.740] that DeSantis was behind it. [04:48.740 --> 04:54.140] So many left-leaning outlets made that claim, Associated Press fact-checkers felt compelled [04:54.140 --> 04:58.180] to publish a determination that the claim is false. [04:58.180 --> 05:04.140] Leaving aside the unconstitutionality of this bill, why is the legacy media exempted? [05:04.140 --> 05:09.500] When Bill Gates gives a media organization millions of dollars, what is he buying? [05:09.500 --> 05:13.220] When Jeff Bezos bought the Washington Post, was that a neutral event without influence [05:13.220 --> 05:16.100] on what the Post covers or how issues are covered? [05:16.100 --> 05:21.060] Do you think Rupert Murdoch owning Fox News doesn't impact what Fox covers or how certain [05:21.060 --> 05:22.900] issues are covered? [05:22.900 --> 05:27.160] In the billion-dollar defamation suit by Dominion Voting Systems against Fox News, internal [05:27.160 --> 05:33.860] communications acquired from Fox in Discovery showed Fox's CEO, Susan Scott, sidelined [05:33.860 --> 05:37.620] a Fox reporter for fact-checking Trump. [05:37.620 --> 05:42.140] Scott's position, stated plainly in her email, was that telling Fox's audience the truth [05:42.140 --> 05:46.820] would be seen by them as a breach of trust and they'd stop tuning into Fox. [05:46.820 --> 05:49.500] Scott directly reports to Murdoch. [05:49.500 --> 05:55.420] My point is that money influences the legacy media just as much as it does the new media, [05:55.420 --> 05:57.020] such as bloggers. [05:57.020 --> 06:01.300] And that's exactly how it was when the founding fathers included freedom of speech, press and [06:01.300 --> 06:03.340] association and the Bill of Rights. [06:03.340 --> 06:07.260] Back then, only wealthy people owned newspapers and they used those newspapers to tell the [06:07.260 --> 06:12.580] community the papers served what the wealthy owner wanted the people to hear. [06:12.580 --> 06:16.500] A few years ago, I did a presentation on which I discussed how the media was in the founding [06:16.500 --> 06:19.980] era, how it progressed over the last two centuries and where it is now. [06:19.980 --> 06:22.540] I'll put a link to that video down in the notes. [06:22.540 --> 06:28.740] The bottom line is Broder is attempting to use law to force bloggers to be transparent [06:28.740 --> 06:31.660] about their funding sources. [06:31.660 --> 06:33.940] But here's the thing. [06:33.940 --> 06:37.740] Transparency is something the government owes us. [06:37.740 --> 06:41.100] We don't owe transparency to the government. [06:41.100 --> 06:44.980] Broder has publicly stated his bill is intended to tackle the fact that bloggers are sometimes [06:44.980 --> 06:48.860] paid by lobbyists to write hit pieces on politicians. [06:48.860 --> 06:53.700] His pitch is that because of the required reports, the public can see who is the money [06:53.700 --> 06:55.420] behind various blog articles. [06:55.420 --> 06:59.660] Of course, I think the real goal is for the politicians who are blogged about to get that [06:59.660 --> 07:00.660] information. [07:00.980 --> 07:06.740] While I can see why he'd want that information, the fact that he wants it doesn't mean it's [07:06.740 --> 07:11.780] constitutional or wise to attempt to violate the right of freedom of speech, freedom of [07:11.780 --> 07:17.660] press and freedom of association as a means of getting the information he wants but to [07:17.660 --> 07:22.020] which he is not entitled. [07:22.020 --> 07:24.100] Talk about a sense of entitlement. [07:24.100 --> 07:29.300] Further, lobbyists are already required by Florida law to be registered and file reports [07:29.300 --> 07:30.500] concerning their activities. [07:30.500 --> 07:35.660] So if Broder wants to know which lobbyists are paying which bloggers, he can attempt [07:35.660 --> 07:40.620] to get that information by amending Florida's laws concerning the reports lobbyists are [07:40.620 --> 07:43.540] already required to file. [07:43.540 --> 07:46.340] Why is Broder targeting bloggers? [07:46.340 --> 07:48.100] Because they're low-hanging fruit. [07:48.100 --> 07:52.620] Broder knows if his legislation did not exclude legacy media, the law would be challenged [07:52.620 --> 07:54.660] in court before the ink was dry. [07:54.660 --> 07:59.340] But bloggers are generally independent, they aren't wealthy, they don't have deep pockets [07:59.460 --> 08:02.700] and they don't have a well-funded national association to pay for a lawsuit. [08:02.700 --> 08:07.180] In other words, from a legal perspective, they're easy to pick on. [08:07.180 --> 08:11.940] Again, I point out that Broder is plainly not a friend of small independent business [08:11.940 --> 08:12.940] people. [08:12.940 --> 08:17.820] Broder's bill is as straightforward as it is unconstitutional. [08:17.820 --> 08:23.420] Phrased another way, while it's blatantly unconstitutional, there is no subterfuge involved. [08:23.420 --> 08:27.300] Broder is plainly stating what he wants and how he wants to get it. [08:27.340 --> 08:31.180] But what have laws written in a misleading way in order to hide what the politicians [08:31.180 --> 08:32.420] are doing? [08:32.420 --> 08:38.460] When an entire legal scheme is shrouded in subterfuge, what should we do about that? [08:38.460 --> 08:43.900] And what do we do when it's not one party or the other that supports the subterfuge [08:43.900 --> 08:45.940] but both parties? [08:45.940 --> 08:51.620] An entire legal scheme shrouded in subterfuge is, of course, the federal income tax. [08:51.620 --> 08:55.100] You've probably heard me say it before, but Congress has never imposed the income tax [08:55.100 --> 08:57.780] on ordinary working Americans. [08:57.780 --> 09:03.660] What do we do as Americans when faced with a pack of jackals in D.C. lying to you in [09:03.660 --> 09:07.660] order to make fools of you and steal your property? [09:07.660 --> 09:13.460] Which is worse, making fools of you or stealing your property? [09:13.460 --> 09:16.980] When faced with a pack of jackals in D.C. lying to you in order to make fools of you [09:16.980 --> 09:22.020] and steal your property, the answer is to put your foot down and stop them. [09:22.020 --> 09:24.060] As Americans, how do we do that? [09:25.060 --> 09:29.060] The first response to jackals in D.C. lying to you, making fools of you, and stealing [09:29.060 --> 09:34.100] your property is to make sure everyone in the country knows what the D.C. jackals are [09:34.100 --> 09:35.260] doing. [09:35.260 --> 09:36.860] How do we accomplish that? [09:36.860 --> 09:39.220] We tell everyone who will listen. [09:39.220 --> 09:40.820] Now here's the rub. [09:40.820 --> 09:45.740] Because most of your fellow citizens believe the lying, thieving jackals, when you get [09:45.740 --> 09:50.140] the word out about what the jackals are doing, you have to know the facts. [09:50.140 --> 09:52.740] You have to deliver the message authoritatively. [09:52.740 --> 09:56.620] Fortunately, I've made that easy for you.
