[00:17.620 --> 00:24.120]  commenters say, well this county or this city, they're still insisting that people
[00:24.120 --> 00:29.520]  wear masks. So I wanted to address how that actually plays out.
[00:29.520 --> 00:42.520]  Let me begin by saying there are some subtleties, some nuances to the authority
[00:42.520 --> 00:47.560]  that the governor has under the medical emergency powers versus powers retained
[00:47.560 --> 00:51.360]  by the county health officials. I'm not going to get into all of that today.
[00:51.800 --> 00:57.520]  However, the important thing is that DeSantis suspended all fines associated
[00:57.520 --> 01:01.680]  with wearing of masks. I want to show you how that turned out in one particular
[01:01.680 --> 01:04.680]  case because a lot of people have said, well, I'm still going to get in trouble
[01:04.680 --> 01:09.280]  because my city or my county. Well, the question is, are you really? What you're
[01:09.280 --> 01:16.480]  looking at is the header from a court decision that was rendered on October
[01:16.480 --> 01:22.480]  23rd, 2020. You can see here the defendant's name, Macy Rebecca, not sure
[01:22.480 --> 01:28.040]  how to pronounce that, Hugely? Hugely? And of course, the plaintiff is the city
[01:28.040 --> 01:31.400]  of Gainesville. Before I get to the court's decision, let me give you a little
[01:31.400 --> 01:35.240]  background on what happened. This is the city of Gainesville, an inspector for
[01:35.240 --> 01:41.600]  the city of Gainesville enforcing a county mask order upon employees. So the
[01:41.600 --> 01:45.880]  inspector walked into a store that was part of a mall, and there was an employee
[01:45.880 --> 01:50.440]  assisting a customer, no mask. So the inspector walked up and asked, is there a
[01:50.440 --> 01:53.640]  reason you don't have a mask? Which I think is a pretty reasonable approach
[01:53.640 --> 01:58.840]  is there are people who are exempt for under all state and county laws
[01:58.840 --> 02:02.760]  concerning wearing a mask. So the inspector said, why are you not wearing a
[02:02.760 --> 02:12.160]  mask? According to the complaint, the defendant, Hugely or Hugely, reached
[02:12.160 --> 02:16.360]  back and didn't say a word, reached back, grabbed a mask, showed the mask to the
[02:16.360 --> 02:21.160]  inspector, but did not give a verbal response to the inspector. So the
[02:21.160 --> 02:28.600]  inspector issued a citation to the employee slash defendant. So they show
[02:28.600 --> 02:33.840]  up in court, and they argue the matter. I'm now going to share with you the
[02:33.840 --> 02:40.680]  court's decision. This is the very last paragraph of the judge's order, and it
[02:40.720 --> 02:45.520]  reads, based on the foregoing, it is ordered and adjudged that a, the
[02:45.520 --> 02:53.240]  defendant, Macy Hugely, Hugely is hereby found to be guilty of the charged
[02:53.280 --> 03:01.440]  infraction. B, pursuant to Governor DeSantis's executive order 20-244, no
[03:01.440 --> 03:06.520]  penalty may be assessed against the defendant for violation of the mask
[03:06.960 --> 03:10.560]  requirement contained in third amendment to the emergency order number
[03:10.560 --> 03:19.440]  20-20-30. Accordingly, no fines or costs shall be imposed in this case. And
[03:19.480 --> 03:23.520]  boom, because when people have said on social media, well, this county or this
[03:23.520 --> 03:28.160]  city is still requiring masks, like, they can't enforce it. You get to court
[03:28.160 --> 03:34.120]  and you get the same judgment as Macy got, which is sorry, the governor said
[03:34.120 --> 03:38.120]  can't issue any fines right now. So that's the way that goes.
